On the 26th of August 2009, the Indian Parliament passed a historic act known as the ‘Right to Education Act’ or RTE Act but the RTE Act was implemented in India with effect from 1st April 2010.

Key Points

  • The Constitution (Eighty-sixth Amendment) Act, 2002 inserted Article 21-A in the Constitution of India to provide free and compulsory education to all children in the age group of six to fourteen years as a Fundamental Right in such a manner as the State may, by law, determine.
  • The Right of Children to Free and Compulsory Education (RTE) Act, 2009, which represents the consequential legislation envisaged under Article 21-A, means that every child has a right to full time elementary education of satisfactory and equitable quality in a formal school which satisfies certain essential norms and standards.

Hint

  • Article 4 - The State shall endeavor to provide, within a period of ten years from the commencement of this Constitution, for free and compulsory education for all children until they complete the age of fourteen years.
  • Article 42 - The State shall make provision for securing just and humane conditions of work and for maternity relief.
  • Article 51: Promotion of international peace and security: The State shall endeavor to promote international peace and security and maintain just and honorable relations between nations.

Hence, Article 21 A of the Indian constitution lays down that education of children aged 6 - 14 years is a Fundamental Right.
