The Constitution was adopted on 26th November , 1949 and came into force on 26th January, 1950. There are 448 articles in the Indian Constitution. Originally, the Constitution of India consisted of the Preamble and 395 Articles. The Constitution defines India as a sovereign, socialist, secular, democratic and republic country. Article 152 of Indian Constitution is an important provision under Part VI. Article 152 provides the definition of the term ‘State’.

Interpretation of Article 152 of Indian Constitution

Article 152 of Indian Constitution states - “In this Part, unless the context otherwise requires, the expression ‘State’ does not include the state of Jammu and Kashmir.”

Article 152 of Indian Constitution provides that the term ‘State’ as used in this part of the Constitution is not applicable to the State of Jammu and Kashmir. The exclusion was based on the special status granted to Jammu and Kashmir under Article 370. The provision allowed the region a greater degree of autonomy and its own Constitution. The exclusion was relevant for interpreting this part of the Constitution and ensuring that references to ‘State’ did not include Jammu and Kashmir. However, following the abrogation of Article 370 on 5th August, 2019, Jammu and Kashmir no longer retains its special status which has altered the interpretation and application of Article 152.

Conclusion

The abrogation of Article 370 ended the special status of Jammu and Kashmir on 5th August, 2019. Following this the exclusion mentioned in Article 152 is no longer relevant and changed its interpretation and application.
