The Constitution of India was adopted on 26th November, 1949. The Constitution establishes the Parliament as the supreme legislative authority in the country. It consists of three key elements: the President of India, the Rajya Sabha (Council of States) and the Lok Sabha (House of the People). Article 84 is one of the important provisions of the Constitution which provides the qualification for membership of Parliament.

Interpretation of Article 84 of Indian Constitution

Article 84 of the Constitution states - A person shall not be qualified to be chosen to fill a seat in Parliament unless he: a) Is a citizen of India, and makes and subscribes before some person authorized in that behalf by the Election Commission an oath or affirmation according to the form set out for the purpose in the Third Schedule b) Is, in the case of a seat in the Council of States (Rajya Sabha), not less than thirty years of age and, in the case of a seat in the House of the People (Lok Sabha), not less than twenty-five years of age c) Possesses such other qualifications as may be prescribed in that behalf by or under any law made by Parliament.”

Qualifications to become a member of the Rajya Sabha (Council of States)

Article 84 lays down the criteria to qualify as a member of the Rajya Sabha which are as follows-

  • Must be a citizen of India
  • Must not be less than 30 years of age

Qualifications to Become a Member of the Lok Sabha (House of People)

Article 84 also provides the essential requirements to qualify as a member of the Lok Sabha -

  • Must be a citizen of India
  • Must not be less than 25 years of age
  • Must be registered as a voter in any Parliamentary constituency to contest for a seat in the House of People
