Murder of Vijay Bhan Kishore

In this case Vijay Bhan Kishore, the son of an Advocate Brij Bhan Kishore who was shot dead by the Appellant. The Sessions Judge convicted the Appellant for murder and sentenced him to death. The Allahabad High Court also upheld the conviction.

Background of the Appellant

The Appellant Dudh Nath Pandey was a motor-car driver and a tenant at a bungalow owned by the family of the deceased. He developed an attraction towards Vijay’s younger sister, Ranjana Kishore, who worked as a teacher at St. Anthony Convent School.

Overtures and Resentment of the Appellant

The overtures of the Appellant towards Ranjana caused discomfort in her family which led to his eviction from the family’s property by Vijay Bhan Kishore.

The Appellant applied to the City Magistrate and alleged that Ranjana was his legally wedded wife. The Magistrate dismissed the application after Ranjana denied the marriage in her statement.

Petition of Habeas Corpus

Threats and Escalation

The Incident

On the day of the incident Vijay was returning home on his scooter after dropping Ranjana at school. The Appellant fired at Vijay using a country-made pistol which resulted in his death.

The Appellant was arrested around 2:30 pm later that afternoon while standing near a pan shop in front of the Indian Telephone Industry where he worked.

In this case the Appellant who had developed an attraction towards the deceased’s sister Ranjana was enraged after being evicted from the family’s property. On the day of the murder, Vijay after escorting Ranjana to school was shot dead by the Appellant. The Appellant claimed an alibi and contended that he was at his workplace at the time of the crime. 

The Supreme Court in this case explained the doctrine of alibi and noted that it requires proof of the physical impossibility of the accused being at the scene of the crime due to their presence elsewhere. The Court in this case rejected the alibi and observed that although the Appellant was at the factory at 8:30 a.m. he could have easily left and committed the crime and returned without his exit being recorded.

The presence of the Appellant near the factory at 2:30 p.m., where he was arrested weakened his plea of alibi. The Court concluded that the actions of the Appellant were driven by his frustration over being rejected by Ranjana and his subsequent resentment towards Vijay. 

Thus, the Supreme Court in this case upheld the conviction and sentence under Section 302 IPC of the Appellant. The Court rejected the defence of alibi as it was unsubstantiated and the case of the Prosecution was supported by reliable evidence.
