In the present case, five hospitals located in Bombay were managed and funded by the State of Bombay. The purpose of the hospital is to provide clinical training to students from a government medical college. 

Administrative control

The administrative control was vested in the Surgeon-General while the daily operations were managed by a superintendent. The Surgeon-General and Superintendent were employees of the State. 

Origin of the dispute

The dispute arose when two hospital employees were dismissed and replaced by former employees of the Civil Supplies Department. The employees who were dismissed challenged their retrenchment and argued that it violated Section 25F of the Industrial Disputes Act which provides compensation and notice before retrenchment.

Writ Petition in the High Court

A writ petition was filed in the High Court of Bombay against their retrenchment. However, the High Court of Bombay upheld the retrenchment, but on appeal, the Court of Appeal ruled that the orders violated Section 25F and declared them invalid. According to Section 2(j) of the Act industry means any business, trade, undertaking, manufacture or calling of employers and includes any calling service, employment, handicraft or industrial occupation or avocation of workmen.

Section 25F(b) of the Industrial Dispute Act, 1947

Section 25F(b) provides that the workman has been paid, at the time of retrenchment, compensation which shall be equivalent to fifteen days average pay for every completed year of continuous service or any part thereof in excess of six months.
